Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," "Seller," or "Merchant") and Locazar ("Locazar," "we," "our," "us") governing your access to and use of the Locazar website, customer application, seller application, and related services (collectively, the "Platform").

By registering for, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. These Terms are published in accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020.

1. Nature of the Platform

Locazar is a hyperlocal marketplace and technology intermediary that connects customers with local/nearby sellers and shops for discovery, listing, and facilitation of transactions. Locazar operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000, and, unless expressly stated otherwise, is not a party to the actual sale or purchase transaction between a Customer and a Seller.

2. Eligibility and Account Registration

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872. Sellers must possess all licenses, registrations, and approvals required to lawfully conduct their business, including GST registration, FSSAI license (where applicable), and Shop and Establishment registration. You agree to provide accurate information, keep it updated, and maintain the confidentiality of your login credentials and OTP.

3. Seller/Merchant Obligations

Sellers agree to provide accurate product descriptions, pricing, images, and availability information in accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Legal Metrology (Packaged Commodities) Rules, 2011, where applicable; display country of origin and other mandatory disclosures; honor listed prices and stock; not sell counterfeit, prohibited, or illegal goods; fulfil orders in a timely manner; and comply with applicable tax laws (GST, TDS/TCS provisions for e-commerce). Locazar may suspend, delist, or terminate any seller account found in violation of these obligations or applicable law.

4. Customer Obligations

Customers agree to use the Platform only for lawful purposes, provide accurate delivery/contact information, make payments through supported and legitimate methods, and refrain from fraudulent orders, invalid chargebacks, abusive behavior, or misuse of promotional offers.

5. Orders, Pricing, and Payments

Order confirmation constitutes an offer by the Customer, accepted upon Seller confirmation. Payments may be processed via third-party payment gateways/UPI providers; Locazar does not store full payment card details. Locazar may act as a payment collection agent/facilitator for certain transactions but does not guarantee product quality, delivery timelines, or fulfillment, which remain the Seller's responsibility unless expressly undertaken by Locazar.

6. Cancellations, Returns, and Refunds

Cancellation, return, and refund policies may vary by Seller and product category and will be displayed at the time of purchase, consistent with the Consumer Protection (E-Commerce) Rules, 2020. Where Locazar facilitates dispute resolution, it acts in good faith based on order records but is not liable for losses arising from Seller-Customer disputes outside its direct control.

7. Grievance Redressal and Consumer Rights

A Grievance Officer has been appointed to address complaints regarding orders, listings, or Platform conduct. Complaints will be acknowledged within 48 hours and resolved within one month, or such timeline as prescribed by applicable law. Contact: support@locazar.com. Customers also retain the right to approach the National Consumer Helpline or Consumer Disputes Redressal Commissions under Indian law.

8. Prohibited Conduct

Users shall not upload unlawful, defamatory, obscene, or infringing content; impersonate any person or entity; attempt unauthorized access to the Platform; use bots or scrapers without authorization; or engage in activities that violate the IT Act, 2000 or any other applicable Indian law. Locazar may remove content, suspend accounts, and report unlawful activity to law enforcement as required.

9. Intellectual Property

All trademarks, logos, "Locazar™," Platform design, source code, and content (excluding Seller-submitted listings) are the exclusive property of Locazar or its licensors. Sellers retain ownership of their listing content but grant Locazar a non-exclusive, royalty-free license to display, reproduce, and distribute such content for Platform operation and promotion.

10. Disclaimer of Warranties and Limitation of Liability

The Platform is provided "as is" and "as available." To the extent permitted by law, Locazar disclaims all implied warranties and shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform or transactions between Customers and Sellers. Locazar's aggregate liability, where applicable, shall not exceed the amount paid by you for the specific transaction giving rise to the claim, subject to mandatory provisions of applicable consumer protection law.

11. Indemnification, Suspension, and Termination

You agree to indemnify Locazar against claims arising from your breach of these Terms or violation of applicable law. Locazar may suspend or terminate your access for violation of these Terms, fraudulent activity, or non-compliance with applicable law. You may close your account at any time by contacting support@locazar.com.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to a consumer's right to approach appropriate consumer forums, any dispute shall be subject to the exclusive jurisdiction of the courts at the location of Locazar's registered office, and, where mutually agreed, may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

13. Modifications to the Terms

Locazar may amend these Terms from time to time to reflect legal, regulatory, or operational changes. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
